The duty is European, the fine is Spanish.
Regulation (EU) 1169/2011 and Spain's Real Decreto 126/2015 require you to declare all 14 allergens on the mandatory list, including for food served unpackaged. The European regulation sets the duty but not the penalties: those come from the Spanish Ley 17/2011 de Seguridad Alimentaria y Nutrición, and they run from €5,000 to €600,000 depending on severity. Questions before you start
Is it compulsory to declare the 14 allergens?
Yes. Regulation (EU) 1169/2011 and Spain's Real Decreto 126/2015 require you to declare all 14 allergens on the mandatory list, including food served unpackaged. The European rule sets the duty; the penalties do not come from it but from the Spanish Ley 17/2011 de Seguridad Alimentaria y Nutrición.
How large are the fines?
The Ley 17/2011 grades offences as minor, €5,000 to €25,000; serious, €25,001 to €100,000; and very serious, €100,001 to €600,000. The Spanish authorities decide how an offence is graded and what the fine comes to. This is general information, not legal advice.
Do I have to mark the allergens in every language?
No. You mark the allergen once on the dish and it appears in ES · CA · NL · EN · DE · FR with the same meaning. You do not copy or translate anything by hand, and you do not pay per language every time you change a dish.
What if a recipe changes halfway through the season?
